Terms of Service

1. Introduction and Agreement
These Terms of Service ('Terms') constitute a legally binding agreement between Rentaflix – Owner: Amikem Chemeza Herve (sole proprietorship) ('Rentaflix,' 'we,' 'us') and you ('User,' 'you'). They govern your use of the web-based property management platform Rentaflix ('App').
By using the platform and agreeing to these Terms, a legally binding contract is established between you and Rentaflix. If you do not agree to these Terms, you may not use Rentaflix.
The processing of personal data is carried out in accordance with our Privacy Policy (available at: https://www.rentaflix.com/privacy). If you store third-party personal data (e.g., tenants) in Rentaflix, you must ensure that you have obtained the necessary consents.
2. Registration and Use of the Platform
2.1 Registration and Login Credentials
To use Rentaflix, you must register with a valid email address and password.
You are responsible for the security of your login credentials and must notify Rentaflix immediately in case of misuse or unauthorized access.
Rentaflix is not liable for any damages resulting from negligent or improper use of your login credentials.
2.2 Permitted Use
You may use Rentaflix only for legally permitted purposes.
It is prohibited to store or use third-party content or data without authorization or in an unlawful manner.
Automated access (e.g., bots, scraping) is strictly prohibited.
You agree to use Rentaflix only for legal purposes and in a way that does not interfere with others' experience.
Prohibited activities include, but are not limited to:
- Fraud, deception, or harassment.
- Uploading viruses, malware, or other harmful software.
- Using Rentaflix for unauthorized advertisements or spam.
We reserve the right to suspend or terminate accounts that violate these Terms.
2.3 User-Generated Content
Rentaflix allows users to upload and share content (e.g., rental properties, lease agreements, documents).
By uploading content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, modify, and distribute your content within the Rentaflix platform
You retain ownership of your content but must ensure that it:
- Does not violate copyright, trademarks, or other intellectual property rights of third parties.
- Does not contain false, misleading, or offensive information.
- Does not include third-party personal data without their consent.
We reserve the right to remove or restrict access to content that violates these Terms.
2.4 License to Use Rentaflix
We grant you a non-exclusive, non-transferable, and revocable license to use Rentaflix for personal or business purposes, subject to these Terms.
You may not:
- Copy, modify, distribute, or resell content from the App.
- Reverse-engineer or decompile software components.
- Use automated tools (e.g., bots, scrapers) to access the App.
3. Subscriptions, Payment Terms, and Cancellation
Rentaflix offers various paid subscription plans with different features. Payments are processed via PayPal, and Rentaflix does not store or process payment information.
3.1 Subscription Types
Fixed-Term Subscription
- Users can purchase a subscription for 1 to 12 months in advance.
- Full payment is required at the start of the chosen period.
- No cancellation or refund is possible during the term.
- Downgrade to a lower-priced plan is only possible after the subscription term ends.
- Upgrade to a higher plan is possible within the last 30 days of the current subscription. The upgrade will be processed as a new fixed-term subscription starting immediately after the current subscription ends. However, users gain access to the upgraded features immediately upon upgrading.
Recurring Subscription
- Users pay monthly or annually in advance.
- Cancellation is possible at any time but takes effect at the end of the current billing period.
- No refunds for the current billing period.
- Downgrade is not possible directly – users must first cancel their current subscription and wait until the end of the billing period before choosing a lower-priced plan.
- Upgrade is only available for monthly subscriptions. Upon upgrading, the new features become available immediately, but the upgrade cost is charged only in the next billing cycle.
3.2 Cancellation and Terms
The term of a paid subscription begins with the payment confirmation.
Rentaflix may cancel a subscription with three months' notice before the end of the billing period.
After canceling a paid subscription, users retain access until the end of the paid period.
Additionally, we reserve the right to immediately suspend or terminate an account if the user repeatedly violates these Terms (e.g., through misuse, fraud, or non-payment).
After canceling a paid subscription, users can subscribe again at any time.
4. Price and Service Changes
Rentaflix reserves the right to adjust prices and service offerings.
Users will be notified at least six weeks in advance of any price changes.
If a user objects to a price increase, Rentaflix may terminate the subscription at the end of the current billing cycle.
Significant changes to the platform will be announced via email or in the App and take effect after notification.
5. Liability and Availability
Rentaflix guarantees 99% uptime, except for scheduled maintenance.
Critical issues will be fixed within 24 hours.
Rentaflix is not liable for:
- Technical failures beyond our control.
- Damages caused by incorrect or outdated user data.
- Losses due to account access issues or misuse of login credentials.
- Issues caused by third-party software or services, including integration failures, disruptions, or security vulnerabilities introduced by external providers.
Rentaflix’s liability is limited to cases of intent or gross negligence. In cases of slight negligence, Rentaflix is only liable for breaches of essential contractual obligations (‘Kardinalpflichten’), but even then, liability is limited to foreseeable damages. This limitation does not apply to damages resulting from injury to life, body, or health.
6. Third-Party Services
Rentaflix uses third-party providers (e.g., PayPal) for payment processing and does not store sensitive payment data.
Rentaflix is not responsible for the services, policies, or actions of third-party providers.
If Rentaflix provides hyperlinks to third-party services, we are not liable for their content, availability, or offers.
To ensure high availability and security, Rentaflix relies on trusted cloud service providers with a minimum of 99% uptime guarantees for document and data storage. These providers implement industry-standard encryption, redundancy, and security measures to protect stored data.
7. Data Protection and Processing
Using Rentaflix requires storing personal data, which is processed according to our Privacy Policy.
If you store personal data within Rentaflix, we provide a Data Processing Agreement (DPA) in accordance with Article 28 GDPR. Users can request this agreement at any time by contacting us.
You are responsible for ensuring compliance with applicable data protection laws, including obtaining appropriate consent when storing third-party personal data (e.g., tenant details).
Rentaflix is not liable for violations of data protection laws resulting from incorrect or unauthorized data entry by users.
Rentaflix is not liable for legal consequences of storing or processing personal data without proper consent.
8. Intellectual Property Rights
All content on Rentaflix (including text, graphics, software, and trademarks) is owned by or licensed to Rentaflix and protected by intellectual property laws.
- You may not copy, reproduce, or distribute Rentaflix content without permission.
- You may not remove or alter copyright notices.
9. Data Export and Account Deletion
Users have the right to export their stored data in Excel or another common, structured, and machine-readable format.
Users can delete their data and account at any time within the App.
Data deletion is initiated by the user and is completed within minutes. After deletion, the user receives an email confirmation. Re-login is no longer possible unless the user registers again.
10. No Right of Withdrawal for Digital Subscriptions
By purchasing a paid subscription to Rentaflix, you gain immediate access to advanced platform features.
By completing the purchase, you expressly agree that Rentaflix provides the service immediately after payment and acknowledge that you do not have a right of withdrawal under Article 16(m) of Directive 2011/83/EU (implemented in §356(5) BGB in Germany)
Important:
- Rentaflix offers a free subscription to test the service beforehand.
- If you no longer wish to use a paid subscription, you can cancel it at any time within the App (see Section 3.2: Cancellation and Terms).
- Refunds are not possible after purchasing a subscription.
11. Changes to the Terms of Service
Rentaflix may update these Terms in the future.
Changes will be announced at least four weeks in advance.
If a user does not object within two weeks, the new Terms will be considered accepted.
If a user objects to the updated Terms, their subscription will continue under the previously agreed Terms until the end of the current billing cycle. If, for legal or operational reasons, Rentaflix cannot continue to provide the service under the previous Terms, we reserve the right to terminate the subscription at the end of the billing period.
